Guantanamo prisoners: US court says due process not for them

Landmark decision means judges at Gitmo's war court are not obliged to consider rights of detainees or their cases through lens of US Constitution.

A federal appeals court in Washington DC recently ruled that Guantanamo Bay prisoners are not entitled to due process - a landmark decision that may have an overarching effect on the prison camp's war court trials, and one that defence lawyers may try to challenge.

A three-judge appeals panel for the District of Columbia Circuit ruled unanimously last week to uphold the indefinite detention of Abdulsalam al-Hela, a 52-year-old Yemeni citizen who was held at a CIA black site for more than a year-and-a-half before being transferred to Guantanamo in 2004, where he has been detained without charge or trial ever since.

Pollak: The Stunning Synergy of The Atlantic’s Anonymous Attack on Trump

The Atlantic published a story Thursday evening that claimed President Donald Trump called the fallen American soldiers in a World War I cemetery “suckers” and “losers” in 2018. The author, Jeffrey Goldberg, cited four anonymous sources.

Nearly a dozen current and former Trump administration officials disputed the story. One, notably, was John Bolton, the former national security adviser who says he will not vote for Trump. “I was there,” he said, and “I didn’t hear that.”

Other claims in The Atlantic story are refuted by documentary evidence. The article claims, for instance, that Trump refused to visit the cemetery because the rain would ruin his hair. Bolton’s tell-all book said otherwise; so do official documents.

What is more interesting than the details of the story is how it was produced, and how it was rolled out. It has the appearance of a well-coordinated, well-executed campaign of disinformation, utilizing the full toolbox available to the Democratic Party.

Iranian Resistance Axis Strikes Back: Convoys With US Equipment Blowing Up In Iraq

On September 3, an explosion of an improvised explosive device (IED) targeted a convoy with equipment of the US-led coalition in the southern Iraqi province of Dhi Qar.

Iraqi troops that were escorting the convoy suffered no casualties. According to local sources, no significant damage was caused to the equipment. Following the incident, security forces detained 2 suspects near the explosion site. The investigation is ongoing.

However, it is no secret that the attack was likely conducted by one of multiple pro-Iranian Shiite groups that surfaced in the country following the assassination of Iranian General Qassem Soleimani and several prominent Iraqi commanders by a US strike in Baghdad in January.

The Pentagon and the US government will not allow an orderly withdrawal from Iraq, because it would telegraph that despite the blood and money spent, we have lost this one.

TSA TRIES OUT ANOTHER (ILLEGAL) BIOMETRIC “ID VERIFICATION” SYSTEM

Today the Transportation Security Administration (TSA) announced that it has launched a “pilot” at Washington National Airport (DCA) of yet another scheme for biometric identification and tracking of domestic air travelers.

The new “touchless ID verification” stations at DCA include a webcam (at top center of photo above) a magnetic-stripe reader (lower left) for drivers licenses and other ID cards, and a photographic scanner for passports (lower right).

Travelers who volunteer to use the new system are directed to insert their drivers license, ID card, or passport into the appropriate reader, stand on a marked spot in front of the webcam, and remove their face mask, so that the image from the ID (or, more likely, from some back-end image database linked to the ID, although that hasn’t been disclosed) and the image from the webcam can be compared by some undisclosed algorithm.

Global Shock After US Sanctions Top International Court Prosecutor Over Afghan Probe

It's not just so-called "rogue states" apparently, but no one is immune from coming under Washington's cross hairs and wrath in the form of economic sanctions and travel restrictions.

US Secretary of State Mike Pompeo just announced sanctions on Fatou Bensouda, the head prosecutor of The Hague-based International Criminal Court (ICC), after the ICC previously opened a formal probe into US soldiers committing war crimes in Afghanistan.

This is after already revoking visas and placing travel bans into the US of other ICC personnel and their families. "Today we take the next step, because the ICC continues to target Americans, sadly," Pompeo said Wednesday.

This shouldn't "shock" anyone; this is how the Unhinged Surveilled State of Amerika rolls in the 21st century; and Mikey, Americans are being targeted because of torture and war crime accusations.

Buchanan: Where Will All These War Games Lead?

In northeast Syria last week, a U.S. military vehicle collided with a Russian armored vehicle, injuring four American soldiers.

Both the Americans and Russians blame each other for failing to follow established rules of the road. Had an American been killed, we could have had a crisis on our hands.

Query: With the ISIS caliphate dead and buried, why are 500 U.S. troops still in Syria a year after Donald Trump said we would be pulling them out? What are they doing there to justify risking a clash with Russian troops who are in Syria as the invited allies of the Damascus regime of Bashar Assad, whether we approve of his regime or not?

Nor was this the only U.S.-Russian faceoff last week.

Just because an action is the most ham-fistedly, pig-headedly stupid thing the US government could do is, unfortunately, no guarantee that it will not do it.

All it takes is one mis-read, one misunderstanding, one not following the rules, and suddenly, we are looking at the US government having gotten this country into a shooting war with..... fill in the blank.

Current hot spots, and situations, include the South China Sea; the border between India and Pakistan; the border between India and China; Belarus; Armenia and Azerbaijan's border; Iran and Israel; Lebanon and Israel; Greece and Turkey squaring off over the Mediterranean oil fields; the Bering sea; and Syria.

There are many in the Bowels of Power in DC who hope for such a war, because it was war that got the US out of the terrible depressions which proceeded both World War I and World War II.

But the situation, with the US and the world, is an entirely different kind of beast in this part of the 21st century.

Many countries now are nuclear-armed and capable; this includes Pakistan; India; China; and Russia. The US weapons systems don't work as advertised; rarely get actually delivered on time, and by the time they are delivered, have been rendered obsolete by other countries' push in weapons technology, and are delivered at cost over-runs large enough to drive a truck through.

The US is dealing with an economic depression of cosmic proportions, exacerbated by Covid-19, and massive riots and unrest in many urban areas; on top of this, it is an election year in this country.

I frankly think, that wise leadership would work as hard as they could to get the domestic issues sorted first, before they would even contemplate a war against a country like Lichtenstein; but then again, that... would be wise leadership.

'Occupy Lafayette Square' Protestors Planning 50 Day "White House Siege", Warn "Things Could Turn Very Ugly"

On Sep. 17, the ninth anniversary of Occupy Wall Street, protestors are planning to begin a “siege” of the White House that will last fifty days - right up until Nov. 3. The website for the event is planning to bring thousands of protestors into Lafayette Square to “lay siege to the White House.”

The site also warns that “the possibility of a civil war breaking out sometime next year is no joke.”

The organizers are citing two main reasons for the planned occupation:

an alleged lack of progress on Wall Street since the 2009 occupation;

and that “Trump is trying to steal the election... and things could turn very ugly very quickly as November 3rd approaches.”

One image used depicts the White House on fire and others show large riots directly in front of the building.

Webmaster's Commentary: 

President Trump has the power to suspend the Constitution and Bill of Rights in the process of declaring a National Emergency; but if these riots are as dangerous to law-abiding citizens as it appears they will be, he may have very little choice here, unfortunately.

And one has to appreciate the irony here; the Demoncrat hangers-oners, and violent leftists are hoping to steal the election through the dispersal of hundreds of thousands of fake mail-in ballots.

Going to Regal Theatres Without A Face Mask

The pretext for their refusal of our entry was that I could not wear a face mask. However, I have a medical exemption from my physician, which is very clearly covered in the executive order on facemasks issued by the South Carolina governor on 8/2/20. The governor’s order clearly states that businesses must honor medical exemptions and may not demand proof of the exemption. Yet as you will see in the video below, the Regal general manager clearly violates this law. He strangely keeps repeating "you must wear a mask, you must wear a mask, you must wear a mask" as I recorded him.

Oregon State Police Are Back In Portland - And This Time They Will Be Sticking Around

While progressives, anarchists, socialists, agitators and their 'woke' enablers in the mainstream press blame right-wing - or 'white supremacist' - groups like 'Patriot Prayer' for the murder of one of the group's own members, the reality is that Oregon Gov. Kate Brown and Portland Mayor Ted Wheeler left an opening for violence to escalate when they pulled out the state police.

Regular readers may remember that President Trump and Department of Homeland Security acting Secretary Chad Wolf finally withdrew federal troops from Portland after reaching a deal for the State Police to protect a federal courthouse in the city. Soon after, Oregon's leading Democrats pulled the reinforcements. But now that a man has been killed, they're realizing the downside of pandering to unstable anarchists.

I have never been more grateful than I am right now about living in rural Indiana, where the term "progressive centrist" is not characterized as an abomination. Family and friends are close, which is a blessing and a God-send. People here are very church-centric, and when exercised with love, kindness, and compassion, is absolutely not a bad thing.

But the thing which shook me, to the core of my being, after this protestor was shot dead, was another anarchist who made the observation "I am not sad that a f---ing fascist died tonight," the woman said to cheers and laughter from the crowd.

"If you're not angry, you're not paying attention," she had said earlier in her speech. "If y'all are not with me, y'all are not paying attention. Everybody needs to realize what's going on in these streets. Our community can hold its own without the police. We can take out the trash on our own."

The woman was referring to the shooting of a member of a pro-Trump organization called Patriot Prayer, which occurred when counterprotesters associated with Black Lives Matter clashed with the rightwing group.

So, assassination of anyone who doesn't absolutely agree with your "method"
is the right thing to do, in your opinion?!?

Can one can be angry, but want to do something creatively positive to address the issues you have, like contribute to the NAACP, or volunteer as a school coach to help a kid who is struggling with reading or math, or volunteer for an after school program to give rootless kids structure after school?!?

Apparently, your answer is, HELL no, Id' rather see that person shot!!

Well, my dear; that makes you a clear and present danger to society; I think, looking at current cultural trends, that Antifa will be declared a domestic terrorist organisation in the not so distant future. But with the violence Antifa supports, as witnessed by this assassination in Portland, you have brought it upon yourselves.

You cannot have a civil society, working together, positively, to address societal ills, torn apart by violence and chaos; the two are mutually exclusive.

California To Set Up Task Force To Examine Slavery Reparations

The California Assembly will vote before Monday on a state Senate bill that creates a task force to look at the question of slavery reparations. The measure passed the state Senate in a bipartisan vote.

This is a surprise. California was a free state when it entered the Union in 1850 as a result of the Compromise of 1850. But now we’re told there was “chattel slavery” in California.

Well… sorta.

Although California before the Civil War was officially a free state, Mitchell listed legal and judicial steps state officials took at the time to support slavery in Southern states while repressing Blacks.

But what about the fact that white people alive today had nothing to do with slavery?

That last question is a large one to me.

And then there is the question of how these reparations will be dispersed; will it simply be a check, written by the State of California, to individuals, or will it be part of a multi-disciplinary program, offering educational, literacy programs, computer literacy programs, counseling to change life-style issues which may be holding people back?!?

The second approach makes more sense to me, but will that wind up making Black Californians more angry?!? I can't tell you, but there is one thing the state of California will not do; that would be tracking how the reparations money will be spent.

How Should The European Union Respond To Rising Greece-Turkey Tensions?

If the European Union can mediate effectively to resolve current Greek-Turkish tensions over energy in the Eastern Mediterranean, it could also provide an opportunity to tackle more deep-rooted problems.

But so far, the two most powerful EU nations have adopted a ‘good cop, bad cop’ approach that conveys different and confusing messages – and has not prevented escalation. Chancellor Angela Merkel, with the added authority of holding the EU’s six-month revolving presidency, has launched a German initiative to prevent escalation, reduce tensions and overcome longstanding conflicts. But French President Emmanuel Macron, while not eschewing mediation, has opted for a show of force, sending French naval vessels into disputed waters to counter the presence of Turkish warships.

Deep-rooted dispute
The dispute is ostensibly over ownership of offshore gas deposits and the delimitation of 200-mile exclusive economic zones (EEZs).

A U.S. Navy warship has transited the narrow and sensitive Taiwan Strait for the second time in two weeks.

Taiwan's Defence Ministry confirmed the operation on Monday amid rising tensions between China and the United States.

The ministry said a U.S. destroyer, which it did not name, had sailed in a southerly direction through the strait and was continuing to sail south.

Mr. President, a word, please; you need to talk to "an adult in the room" regarding China, and the US's current "picador stance" against it.

There is a point past which China's President Xi cannot allow these incursions to stand, without "losing face" to his Asian Pacific neighbors, and it appears that the US is attempting to provoke him to respond.

I would strongly suggest, Mr. President, that this is the most ham-fistedly, pig-headedly wrong move the US could possibly make at this time.

We don't have the money; the troop strength; the weaponry; or the manufacturing to pursue a positive outcome in a war against China at this point.

Besides which, after World War Two, courtesy of the Cairo Pact, the South China Seas were ceded to China by this agreement.

China says United States should 'brush up on' South China Sea history the article goes on to state:

"The United States needs to brush up on its history about the South China Sea, as World War Two-related agreements mandated that all Chinese territories taken by Japan had to be returned to China, Chinese Foreign Minister Wang Yi said in Australia."

If, in fact, the US "gave its word" that this would remain true, why is the US attempting to break that word by these repeated "Freedom of Navigation" exercises?!?

There is only one explanation; it is to make President Xi act first, so that his actions against American military hardware and personnel, cast him as "the baddie" in the eyes of the world, so that the US response to this "outrage" will appear "justified."

Police have responded to reports of fire being opened at a pro-Trump parade of cars in Woodland Hills, California, after a tire was slashed by a projectile, probably a bullet. The alleged shooter is at large.

The incident unfolded about 11:30 a.m. local time in the 20600 block of Ventura Boulevard, as the torrent of cars with Trump supporters was streaming past Woodland Hills, a neighborhood in the San Fernando Valley region of Los Angeles, California.

“I have long condemned looting, violence, threats...but let’s take a step back. This isn’t just happening in one place. It’s happening all over the country. It is happening under Donald Trump’s watch,” Sen. Amy Klobuchar (D-Minnesota) told ABC News on Sunday morning.

The senator was reacting to a clip of a speech where the president called out protesters who harassed his supporters leaving the Republican National Convention (RNC). One of those supporters was activist Brandon Straka, who claimed he and colleagues were assaulted and he even captured video of the demonstrators hurling homophobic slurs at him.

Portland, Kenosha, and Chicago have one striking thing in common; they are all run by Democrat mayors; they have failed all the good citizens of their cities by allowing riots to get out of hand, to the point where people are getting killed by rioters.

Are We Deliberately Trying To Provoke A Military Crisis With Russia?

Tensions are becoming dangerous in Syria and on Russia's back doorstep.

A dangerous vehicle collision between U.S and Russian soldiers in Northeastern Syria on Aug. 24 highlights the fragility of the relationship and the broader test of wills between the two major powers.

A sober examination of U.S. policy toward Russia since the disintegration of the Soviet Union leads to two possible conclusions. One is that U.S. leaders, in both Republican and Democratic administrations, have been utterly tone-deaf to how Washington’s actions are perceived in Moscow. The other possibility is that those leaders adopted a policy of maximum jingoistic swagger intended to intimidate Russia, even if it meant obliterating a constructive bilateral relationship and eventually risking a dangerous showdown. Washington’s latest military moves, especially in Eastern Europe and the Black Sea, are stoking alarming tensions.

Provoking Russia may "play well" to America's illiterate, innumerate, and illogical groundlings who, for generations have been fed the "Russia-bad!! geopolitical poison"; but logically, at this point in the 21st century, it is counterproductive to any peaceful future with Russia, and that... is stupid beyond belief.

President Putin is a cautious man, with a very deep understanding of history; he is working toward improving the standards of living for his people, making Russian business sound, and does not want any real provocation with the US or the West.

President Trump eschews a real, and meaningful dialogue with him, on issues like nuclear non-proliferation, at the peril of starting world war III.

And Mr. President, a word on that, please; the US military doesn't have the weaponry; the troop strength; the money; or the manufacturing to insure a positive outcome in a shooting war against Russia.

And with weaponry, this country is consistently behind the proverbial 8-ball, compared to Russia and China. And why is this?!?

This is because the guys you play golf with, who represent the military industrial complex, believe that once they have contributed mightily to a President's successful election campaign, they don't have to deliver better weapons, at less cost, on time, and within budget, which actually perform as they advertise.

Mr. President, forgive me, but ..... there, in a nutshell, is your problem, and unless and until this is dealt with, intelligently and swiftly, the US military will continue to lag behind in weapons development for weapons which actually work as advertised.

And sir, if you don't believe me, please observe the performance of Russia's S-400 in Syria; it's no secret that other countries are lining up to purchase Russian weaponry systems, because they do work as advertised.

Pinterest Pays $89.5 Million To Abandon Upcoming Lease In San Francisco

Things are going so great in California that Pinterest just paid $89.5 million to cancel its 490,000-square-foot lease at the upcoming 88 Bluxome project in San Francisco.

The company blames working from home as a result of the pandemic as the reason for abandoning the lease - but we're sure the state's rising taxes, impending real estate market crash and conversion of the property to a temporary homeless shelter in March likely helped contribute to the decision making.

Either way, Pinterest wanted out of the lease so badly they were willing to fork over a hefty sum to ensure they would not be held to it. The company's total lease obligations for the property would have amounted to $440 million.

Yes, really.

The article was written by Jonathan Levinson for Oregon Public Broadcasting, the Portland NPR affiliate.

Portland has experienced 93 days of continuous rioting – last night was the first time in that entire period that the city has not seen unrest – but according to Levinson, merely calling a spade a spade is a racist dog whistle.

Levinson’s argument for this position is vague to the point of being non-existent. He appears upset that police are able to declare a riot and use crowd control measures to disperse violent BLM mobs.

“Any” means “any”. That would include the (admittedly hypothetical) case of Trump clearly winning in by landslide. Again, “any” means “any”.

The direct implications of that is that the Dems should re-take the White House by any and all means and under any and all circumstances.

That is also a direct appeal to sabotage the US democracy which, as flawed as it is, is the only rule of law based option currently available to the people of the USA.

Will that result in a civil war?

That is rather unlikely, because for a civil war you need to have at least two credible parties which can coordinate attacks and defensive operations on, at least, a regional scale. I don’t see that in the USA.

But I don’t see how local/regional violence (at times severe) and political chaos can be avoided.

Schiff, Pelosi Livid After Intel Community Ditches 'Manipulated' Election Briefings For Written Updates

House Democrats are livid after the Director of National Intelligence, John Ratcliffe, announced that US intel agencies would be pulling the plug on in-person congressional briefings on election security, and will instead be providing written updates ahead of November.

In a verbal notification to the House Intelligence Committee, chaired by Rep. Adam Schiff (D-CA), Ratcliffe argued that the process will prevent the unauthorized disclosure of sensitive information, according to The Hill.

Ratcliffe followed up with Friday letters addressed to top House and Senate lawmakers in which he emphasized that the Office of the Director of National Intelligence (ODNI) plans to continue Congressional oversight efforts.

"The ODNI will primarily meet its obligation to keep Congress fully and currently informed leading into the Presidential election through written finished intelligence products," read the letters, which were obtained by The Hill.

Is Syrian Oil Now A ‘U.S. National Interest’? We want to hear how keeping our troops there in harm's way is 'America First.'

Sure, officially, the military says we are there for stability operations, keeping the peace between the competing factions in the contested areas of Northeastern Syria near the Turkish border. They will say we are still patrolling with Kurdish fighters against the remnants of ISIS. More importantly, however, is Trump’s reason for leaving some 500 troops there—for protecting the oil fields from the Syria government on behalf of the Kurds. More on that in a minute.

While RNC surrogates were congratulating Trump for “rebuilding the military” and his America First virtues in countering China and Iran last night, four American soldiers were recuperating from injuries sustained when a Russian armored vehicle sideswiped their own Mine-Resistant Ambush Protected All-Terrain Vehicle (M-ATV) as they were both racing down a highway in Dayrick near the Turkish border on Aug. 24.

A new study from CloudResearch reveals that 11.7% of Republicans won't admit their political preferences to pollsters - which is more than twice the number of Democrats at just 5.4%.

CloudResearch also found that "10.5% of Independents fell into the "shy voter" category, just a percentage point lower than how Republicans react to phone polls."

When asked why they wouldn't be truthful in their responses, "shy" respondents cited six concerns:

1. A lack of trust in phone polls as truly being anonymous.

2. An apprehension to associate their phone numbers with recorded responses.

3. Fear that their responses will become public in some manner.

4. Fear of reprisal and related detrimental impact to their financial, social, and family lives should their political opinions become publicly known.

Sixty-six organizations representing over 7.5 million members sent letters to Home Depot (NYSE: HD) and Lowe’s (NYSE: LOW) today urging them to remove Roundup and other glyphosate-based herbicides from store shelves and online sales. The organizations, representing consumers, environmentalists, beekeepers and farmers, also urged the companies to expand sales of organic and other safer alternatives. Competitors Costco (NASDAQ: COST) and B&Q have already announced commitments to phase out glyphosate-based products.

While US regime change in Syria appears to be a terminal failure, various propaganda ploys used to sell the war continue in the hopes that - at the very least - such ploys can be polished and improved upon when and where the US turns its attention next.

The accused - Anwar Raslan, a former colonel in the Syrian military, and co-defendant Eyad al-Gharib, who allegedly worked under Raslan, had been living in Germany as refugees and were arrested in February last year.

Germany is using a legal principle called universal jurisdiction to trial Raslan and al-Gharib.

This allows German prosecutors to work on war crimes cases, whether they have a close connection to Germany or not.

Universal jurisdiction could result in an alternative means for the international community to bring war criminals to account.
