An elderly couple in St. Louis County found out what happens when you honk your horn at a cop this past weekend, when the officer drew his gun and pistol whipped the man in the face, while wrestling with the woman as she attempted to defend her husband.

Describing the harrowing incident to local reporters, Janet and Donald Akers noted that they were unable to pay their respects to Janet’s deceased mother on Mother’s day, as they were beaten up by the cop before they could get to the graveyard.

In a decision published Tuesday, a panel of 11th circuit judges overturned the ruling the same circuit court made last year in US vs. Davis, which found that obtaining Davis’ past cellphone location without a warrant violated his fourth amendment right to privacy. The new ruling instead finds that because Davis’ phone location data wasn’t Davis’s property, but the property of his phone carrier, MetroPCS—a legal argument known as the “third party doctrine”—he had no expectation of that data’s privacy, and the cops tracking him didn’t in fact need a warrant.

According to the suit, which was spotted by Ars Technica, Intermex made employees install the Xora GPS app so the company could track them at all times. Myrna Arias claims that she told her boss, John Stubits, that she was fine with the tracking while she was on duty, but opposed to it during her off hours and weekends. The suit alleges that a group of co-workers agreed with this position. After doing some research about Xora, Arias uninstalled the app in April 2014.

After researching the app and speaking with a trainer from Xora, Plaintiff and her co-workers asked whether Intermex would be monitoring their movements while off duty. Stubits admitted that employees would be monitored while off duty and bragged that he knew how fast she was driving at specific moments ever since she installed the app on her phone.

Hillary Clinton Has 1 Day to Take a Serious Stand on One of the Biggest Corporate Trade Deals in US History

The Democratic Party is now in an all-out war over the Trans-Pacific Partnership (TPP), with labor unions, environmentalists, and other public interest groups opposed to fast tracking the deal – which would allow it to have a vote with no amendments -- battling corporations and President Obama who are for fast track. The big vote on TPP in the US Senate is on Tuesday.

One voice who has been silent in this internecine conflict is Hillary Clinton. Clinton has refused to say whether she supports granting Obama fast track authority, let alone whether she supports the overall agreement. Rainwater collection being criminalized in U.S. to solidify total government dependence

You might be aware that it is illegal to collect rainwater on your own property in some states, but did you know that doing so could actually land you in jail? That is exactly what is happening to Gary Harrington of Eagle Point, Oregon. He is now facing a 30-day jail sentence and fines of more than $1,500.

His crime? Harrington has been collecting rainwater in three reservoirs on his property, and the government doesn't like it. In Oregon, all water is considered property of the state whether it flows from the tap or falls from the sky.

The Prison Gates Swing Open for US Peace Activists

Kathy Kelly is just out of prison, where she’d been sent for nonviolently opposing drone murders.

An appeals court has just overturned convictions for Megan Rice, Michael Walli and Gregory Boertje-Obed, imprisoned for entering and protesting a nuclear weapons site at Oak Ridge, Tenn., three years ago. Resentencing on lesser charges, and quite possibly immediate release, is expected.

Amazingly, the Sixth Circuit Court of Appeals ruled 2-1 that the government failed to prove that the activists intended to “injure the national defense.” (Maybe Venezuela, accused by President Obama of being a threat to the same, should appeal to the Sixth Circuit!)

The U.S. government has just dropped charges against eight members of the National Campaign for Nonviolent Resistance who nonviolently protested the U.S. military’s environmental destruction with a march from the EPA to the Pentagon this past Earth Day.

These are small wins, in the battle for peace and justice, but they are wins.

When Obama Talks About His "Massive Fight" With Wall Street, What Exactly Does He Refer To?

On one hand, none other than the company whose very future depends on the continuity of the financial status quo (that would be Bloomberg whose 200,000 Bloomberg terminals are the cashflow lifeblood of the company and for which another financial crash would mean a huge hit to the bottom line as millions of financial workers are again laid off) has a cover story, as well as a cover, depicting Elizabeth Warren as Wall Street's bogeyman.

On the other hand, we now learn that Warren is also warning that Obama's pet trade project, the 12-nation Trans-Pacific Partnership (TPP) which is supposed to counter the ascendence of China in global trade, has been warning about the potential damage of the trade deal and has been arguing that the deal would cost American jobs (for more on the topic, see "Free Trade Is Plutocratic Propaganda").

And Obama is not happy: according to the NYT, Obama called Warren "absolutely wrong" in his criticism of the TPP.

How prisons have become a cash cow for the rich

And it’s not just the phone companies that are getting rich off prisoners’ phone calls.

Thanks to so-called “commissions” that can account for as much as 94 percent of the cost of a call, prison phone contracts have become a major source of revenue for state and local governments all across the country.

These glorified kickbacks have also become a source of revenue for prisons themselves, and they use them to pay for the health care and food services they’re already constitutionally required to provide.

In other words, like pretty much every other case of privatization over the past few decades, the rise of private prison phone contracts has nothing to do with “efficiency” or “improving services” and has everything do with making a quick buck for some crony capitalist with a bunch of Republican friends in Congress.

The privatization of prisons in this country has guaranteed an horrific rise in recidivism (re-offending, going back to prison), which means that the private prisons have become great investment opportunities (for people with the morals of a trout, that is).

Sweden is CLOSING many of its prisons, and why?!? Because the total focus of prison time is rehabilitation, rather than punishment, and reintegration with society when the prisoner is released.

It is a sane, and compassionate model, which is why it is completely ignored by the penal system here in the US.

BBC WANTS GOOGLE TO REMOVE TOP GEAR’S IMDB PAGE

This week BBC Worldwide reported a record number of infringing links to Google, targeting more than 25,000 webpages. We decided to go through the links and it wasn’t hard to find several URLs that are clearly not infringing.

For example, one of the notices targets the IMDb pages of Top Gear, The Game and Top Fails.

The Internet Movie Database is one of the prime sources for movie and TV fans to get information and doesn’t host or link to infringing content, so taking these pages offline only hurts the BBC.

Perhaps even more worrying is that the same notice also lists the British home of the video site Dailymotion as “infringing.” While this page may have linked to unauthorized material in the past, it’s certainly doesn’t warrant the removal of the entire homepage.

Federal Courts Green Light Police Access to Cellphone Tower Records without a Warrant

A federal appeals court has ruled that law enforcement agencies may access tracking information on cell phones without a warrant. The 11th Circuit Court of Appeals ruled (pdf) Tuesday that police were justified in asking a mobile phone provider to hand over the records of Quartavious Davis, who was convicted of committing seven armed robberies in South Florida in 2010. As part of the evidence used against Davis, prosecutors presented data showing that Davis’ phone was using cell towers near sites of robberies.

Teens Explosives Meant For Melbourne Bombing

A Melbourne teenager arrested in dramatic raids was planning to bomb an event within days, police say.

“National security is something you read about in the newspaper; safety is something you feel,” he said. “It’s something that — even though as a governor I don’t deal with it day in and day out — it has increasingly become one of the most important things for me to focus in on, because when I think about safety, I think about my own children and I think about yours as well.”

Jeb Bush Courts Christian Conservatives In Commencement Speech

Charging that "the Christian voice" isn't heard enough in the world, the Republican White House prospect lashed out at the Democratic president's administration for "demanding obedience in complete disregard of religious conscience."

"The present administration is supporting the use of coercive federal power. What should be easy calls in favor of religious freedom have instead become an aggressive stance against it," Bush told an estimated 34,000 gathered for a graduation ceremony.

"Somebody here is being small-minded and intolerant, and it sure isn't the nuns, ministers, and laymen and women who ask only to live and practice their faith," he said.

Panic on Mass Common Core Test Refusals, Threaten Reprisals

Public resistance to Common Core is exploding across America, and officials are not happy about it. The Obama administration’s Department of Education, along with pro-Common Core government officials across the country under pressure from the feds, appear to be in panic mode. Facing a growing nationwide “opt out” movement to refuse participation in the unconstitutional federally funded testing regime aligned with the Obama-backed national school standards, senior bureaucrats, including Education Secretary Arne Duncan, have actually started resorting to lawless threats against parents, teachers, students, and entire state governments. Some parents were threatened by officials with jail time. Even small children are being punished by the state for “opting out” of the deeply controversial tests, with one California mother telling The New American that her daughter was publicly denied ice cream in retaliation.

But so far, the threats are only emboldening the opposition.

Webmaster's Commentary: 

I have known teachers hired by a private education organisation to implement Common Core here in Hawaii: it was an unmitigated disaster; prevented the kids from truly learning; discouraged critical thinking; and made the child feel like little more than a herd animal.

One of the outcomes I would love to see happen from this growing federalization of education is a massive movement toward home schooling, either individual or group, and supported by states which are truly education friendly.

In short order, it leaked that Moscow was set to advance Greece $5 billion against the future potential profits from the pipeline, a payment which we characterized as a get-out-of-Troika-jail free card and although conflicting reports emerged thereafter regarding just how soon money would actually be flowing from Moscow to Athens, discussions around the pipeline continued to move forward when Gazprom chief Alexei Miller visited Greece late last month to discuss “current energy issues of interest.”

That visit proved more than Europe could bear, and so the European Commission promptly filed antitrust charges against the Russian gas giant in an absurdly transparent attempt to punish the Kremlin for interfering in negotiations between the EU and its Aegean debt serf.

The US is applying political pressure to Greece in an effort to dissuade Athens from participating in Russia's Turkish Stream Pipeline project which has been implicitly used, at various times, as a negotiating tactic in discussions with EU creditors. As the Times suggests, this is further evidence that Washington is becoming increasingly concerned that the world is rapidly shifting away from the US-dominated, unipolar model that has existed, in one form or another, since the collapse of the Soviet Union. This consternation is beginning to manifest itself in the revitalization of Cold War politics.

Egyptian court sentences Mubarak, sons to three years in jail

A previous court decision to drop charges against him of conspiring to kill protesters in the uprising, centered in Cairo's Tahrir Square, and the release of some of his associates from jail have cast doubt over Egypt's political transformation.

Last May, Mubarak was sentenced to three years in prison on charges of diverting public funds earmarked to renovate presidential palaces and using the money to upgrade family properties. His two sons were given four-year jail terms in the same case.

In January, Egypt's high court overturned the convictions, and the case went back to court for retrial.

"The ruling of the court is three years in prison without parole for Mohamed Hosni Mubarak and Gamal Mohamed Hosni Mubarak and Alaa Mohamed Hosni Mubarak," Judge Hassan Hassanein announced on Saturday.

In a little-noticed brief filed last summer, lawyers for the House of Representatives claimed that an SEC investigation of congressional insider trading should be blocked on principle, because lawmakers and their staff are constitutionally protected from such inquiries given the nature of their work.
