The Supreme Court on Friday ruled that the right to a trial by jury and to due process apply to people who face a steep sentencing enhancement under federal law, in a ruling that transfers some power from the hands of judges to the public and will affect many criminal defendants' future punishments.

The procedural history of the case is a bit of a whirlwind. But at its center is Paul Erlinger, who was charged in 2017 with being a felon in possession of a firearm and sentenced to 15 years under the Armed Career Criminal Act (ACCA), which increases the punishment for that offense—felon in possession of a firearm—from a 10-year maximum to a 15-year minimum if the defendant has been convicted previously of three violent felonies or serious drug offenses on separate occasions.

At sentencing came one of the initial twists, when the judge who handed down the 15-year punishment made clear it was inappropriate. Erlinger, who pleaded guilty, had gained steady employment, started a family, and remained drug-free in the more than a decade since his previous convictions, so a five-year sentence, the judge said, would be "fair." But under the ACCA, the court's hands were tied.

A federal law that Congress enacted in 1994 prohibits gun possession by people subject to domestic violence restraining orders. Since that seems like a no-brainer, many people were dismayed when the U.S. Court of Appeals for the 5th Circuit deemed that provision unconstitutional last year in United States v. Rahimi. But as anyone who reads the majority and concurring opinions in that case can see, there is a striking problem with 18 USC 922(g)(8): It disarms people even when there is little or no evidence that they pose a danger to others.

For those seeking balance in this polarized moment in American politics, Gallup offers news that initially seems good. The polling firm finds Americans are becoming increasingly socially liberal while generally remaining economically conservative. Using a crude definition of libertarian and classical liberal ideas, growing social liberalism paired with economic conservatism sounds encouraging. But the ideological shift is all one-sided, with Democrats moving left much more than Republicans moved to the right—threatening not balance, but a wider partisan divide.

The year millions of people were killed worldwide by a virus likely engineered in the Wuhan Institute of Virology, Chinese scientists in Beijing began toying with a more deadly coronavirus variant called GX_P2V that killed humanized mice 100% of the time, largely with late-stage brain infections. While not formally linked, the study referenced parallel work executed by Wuhan Institute of Virology scientist Dr. Shi Zhengli.

In March, Chinese researchers at the Hebei Medical University revealed they had created a mutant version of the virus vesicular stomaitis, known to infect cattle, by giving it a protein from the Ebola virus. The hamster test subjects infected with the recombinant virus suffered weight loss, ulcerated eyes, inflammation, multi-organ failure, and then all died.

Apparently, the Pentagon has no idea to what extent it has bankrolled these kinds of potentially ruinous experiments in communist China.

Jamaal Bowman, the controversial New York congressman, often appeals to his work as a former school principal and his Ed.D. in education as the basis for his policy positions.

But, according to our analysis, Bowman’s primary academic work — his 2019 dissertation, “Community Schools: The Perceptions and Practices that Foster Broad-Based Collaboration among Leaders with the Community School Ecosystem” — is riddled with basic errors, failures of logic, and multiple instances of plagiarism. (Bowman did not return a request for comment.)

Bowman has boasted about the paper on social media and considers it formative to his political orientation. When asked recently about his political views, Bowman said, “I identify as an educator, and as a Black man in America. But my policies align with those of a socialist, so I guess that makes me a socialist.”

Three people were killed and 10 others were injured in a shooting at an Arkansas grocery store late Friday morning, according to state police. The shooting occurred around 11:30 a.m. local time at the Mad Butcher market in Fordyce, about 70 miles south of Little Rock, Arkansas State Police Director Mike Hagar said at a news conference. He said there was only one lone suspect involved.

The Israeli Defence Forces (IDF) is facing increasing challenges as the war against Hamas enters its ninth month. On Monday, Israel lost eight soldiers in an explosion in Rafah, in what Israeli media called the “deadliest incident for IDF” in six months. The number might seem small in the context of the war in Gaza, but the number is far too high for Israeli public opinion.

A week before the explosion, Hamas claimed to have killed an unspecified number of Israeli soldiers after its fighters detonated a booby-trapped house in Rafah.

‘An exhausted army’

The losses underscored Israel’s army chief Herzi Halevi’s warning in recent days about shortages in the military, saying it would prevent Israel from waging the war against Hamas with the same intensity.

Nigel Farage has said the EU and Nato “provoked” Russia’s invasion of Ukraine by expanding eastwards, as the Reform UK leader was challenged over a series of policies and beliefs in a sometimes combative TV interview.

Speaking to BBC’s Panorama on Friday evening, Farage also said Brexit would have benefited the UK economically if he had been running the country, and that many of the Reform candidates criticised for saying offensive things had been “stitched up in the most extraordinary way”.

Challenged on his beliefs over the invasion of Ukraine, and his stated admiration for Vladimir Putin, Farage said he disliked the Russian president personally but “admired him as a political operator” because of the extent of his control over Russia.

On why Putin invaded Ukraine, Farage said: “I stood up in the European parliament in 2014 and I said: ‘There will be a war in Ukraine.’ Why did I say that? It was obvious to me that the ever-eastward expansion of Nato and the European Union was giving this man a reason … to say: ‘They’re coming for us again,’ and to go to war.”

The BBC has a story today about the heatwave in May and early June the southwestern U.S. and Mexico. Apparently, a report by the World Weather Attribution (WWA) group has claimed that climate change made the heatwave 35 times more likely, though exactly what that means goes unexplained.

The interesting thing about that BBC story is the complete lack of any mention of the spectacular plunge in temperatures across the northwestern United States as a major winter storm crossed over the Rockies into Montana and Idaho. Newsweek has the story:

Six years after California legalized marijuana, the bodies keep piling up. Earlier this year, six men were murdered in the Mojave Desert. Four of the men had been burned after being shot with rifles. In 2020, seven people were killed at an illegal pot operation in Riverside County.

Violence like this was supposed to disappear after legalization. Legalization advocates argued that making the drug trade legal would end the grip of the cartels. Instead, the legal market has failed, and the cartels are taking over sizable parts of California and the rest of the country.

California's legal drug revenues have fallen consistently, as have those in other legal drug states including Colorado, whose model helped sell the idea that drug money would fix everything.

Despite falling revenues, Colorado legislators brag about $282 million in drug revenue. That number may sound high, but it's a drop in the bucket considering the money that the state and cities like Denver are spending on homelessness, drug overdoses and law enforcement.

A disturbing new study has warned that all recipients of Covid mRNA injections are facing a ticking time bomb where they could be struck down with a sudden brain clot at any moment, without warning.

A new preprint study published and coauthored by Dr. Peter McCullough describes how the Covid vaccination has a much greater risk of causing blood clots in the brain versus the Influenza vaccine.

“There is an alarming breach in the safety signal threshold concerning cerebral thrombosis AEs after COVID-19 vaccines compared to that of the influenza vaccines and even when compared to that of all other vaccines,” the study said in the ‘Conclusions’ section.

“An immediate global moratorium on the use of COVID-19 vaccines is necessary with an absolute contraindication in women of reproductive age.”

New Jersey lawmakers are backing a push in Congress to exclude non-U.S. citizens from the census results that determine each states' share of House of Representative seats.

A resolution filed by state Sen. Joseph Pennacchio, R-Montville, expresses support for the federal “Equal Representation Act,” which would modify the apportionment of House seats, as well as electoral college votes, to be based on the population of U.S. citizens.

“Appropriating representatives to Congress based on citizenship is the only formula that allows for accurate representation in our federal government," Pennacchio said in a statement. "It is imperative that the right of each American citizen to receive equal representation in government is protected from dilution.”

On Friday, CNN legal expert Elie Honig thoroughly dismantled The New York Times’ latest hit piece targeting former President Donald Trump’s ongoing legal battles. The Times op-ed, penned by Leah Litman, a professor at the University of Michigan Law School, cast aspersions on the Supreme Court’s handling of Trump’s immunity case and suggested that political maneuvering is at play.

Litman criticized the Supreme Court for a slow response to Trump’s immunity case, claiming an unusual delay. The Saudi Arabian Embassy in London warns of the risk of world war after the announcement of an imminent Israeli invasion of South Lebanon : " It is important that everyone understands the danger that awaits us. The conflict will not remain regional, but will very quickly become international. "

Egypt has sent multiple messages to Washington saying: Do not underestimate Nasrallah’s statements or the capabilities of Hezbollah."

The Idaho Department of Water Resources (IDWR) issued a curtailment order for eastern Idaho irrigators who were found to be noncompliant with a state-approved mitigation plan. This order was scheduled to go into effect recently. The curtailment order impacts about 6,400 junior groundwater rights holders who pump water from the Eastern Snake Plain Aquifer. This aquifer supplies water to the Twin Falls Canal Co, which has senior water rights.

"Although, of course, reporters would like him to do so much more often. But this is going to be a robust preparation led by his former chief of staff, Ron Klain, who has also been his right-hand man for much of his career, and we know that his closest advisors will be huddled with him at Camp David to prepare for this debate."

Yada, yada, yada. Now here's what Jiang said that really caught my attention:

They argue when it comes to the economy and building more jobs when it comes to issues of democracy having to do with January 6, and so we should expect some of that. But, I'm also told that we should expect some surprises as well, because this is such a critical performance for President Biden not only on the content, but on his physical performance as well.

Well, that is interesting. We should be surprised by Biden's "physical performance" as well? Why is that? Lately, the Biden campaign has been dogged by a slew of viral videos showing Biden's physical and cognitive deterioration. Why, exactly, are we going to be surprised?

Earlier this year, Democrats were counting on Joe Biden's State of the Union address to reset his campaign, and Democrats spent weeks touting his performance as proof he was physically and mentally fit enough to handle the presidency. But Dr. Carole Lieberman, a forensic psychiatrist based in Beverly Hills, Calif., observed that Biden’s speed and volume during the speech suggested that he was drugged.

China shunned the Switzerland-hosted peace talks attended by some 90 countries and which happened last week, however, the government of Xi Jinping has urgently called for an international peace summit hosted by Beijing. China's rationale for skipping the Swiss summit was that the endeavor was futile without Russia's presence.

Geng Shuang, China's deputy permanent representative to the United Nations, recently told the United Nations Security Council in New York, "China calls on the parties to the conflict to demonstrate political will, come together, and start peace talks as soon as possible to achieve a ceasefire and halt military actions."

Claire's Observations:  China is looking for opportunities to become "The Adult in the Room" with regard to international relations, and mediation.  Of course, the US and NATO will shoot this possibility down in short order.

Balkan Peninsula Power Outage: On Friday, a massive power outage affected the Balkan Peninsula, impacting Montenegro, Croatia, Bosnia, and parts of Albania. The cause of the blackout remains unclear, and efforts are underway to determine the exact issue. Montenegro experienced the most significant impact, with nearly the entire country losing power due to a network failure. Major cities in Bosnia, including Sarajevo, Mostar, and Banja Luka, also faced blackouts.

Senior Congressional Correspondent for Fox News Chard Pergram wrote, “Fox is told that Democrats would likely move to table or kill the resolution to hold Garland in “inherent contempt.” Thus, the vote is one step removed from an actual up/down vote on inherent contempt. If the House moves to the table, the issue is dead. However, if the House rejects tabling the measure, it proceeds to hold a vote on actual inherent contempt. Fox is told that Garland has reached out to moderate Republicans, pushing them to reject inherent contempt.”
