The U.S. Court of Appeals for the 11th Circuit ruled that separating bathrooms based on sex doesn't violate the Constitution or Title IX, a decision with repercussions for the nationwide debate over transgender issues.
The ruling is likely to have widespread consequences in Alabama, Florida, and Georgia.
The case, Adams v. Sch. Bd. of St. Johns Cty, revolved around whether or not St. Johns County School Board in Florida violated a transgender student's rights by prohibiting the student, a biological female who identifies as a boy, from using the boys' bathroom at Allen D. Nease High School. The court ruled en banc that the United States has a long tradition of segregating certain spaces, such as bathrooms, on the basis of sex, without falling afoul of either the equal protection clause of the 14th Amendment or Title IX, which prohibits sex-based discrimination in education. As such, the student's rights weren't violated.
"Separating school bathrooms based on biological sex passes constitutional muster and comports with Title IX," Judge Barbara Lagoa, who was appointed by President Donald Trump, wrote for the court. Four judges appointed by Democrats dissented from the opinion.
California Democrat Rep. Adam Schiff may be planning to leave the House and run for the U.S. Senate, but he likely won’t be the only one vying for the seat.

That may not be quick enough for what could turn into a vicious succession race among Democrats. California Democratic Reps. Barbara Lee and Adam Schiff are also among the slate of Democrats eyeing the Senate seat, which Feinstein first won in 1992,” Politico reported.
Business magnate Elon Musk, who purchased Twitter last year, suggested in a tweet on Wednesday that President Joe Biden's administration might attempt to "weaponize" the federal government to target Twitter if former President Donald Trump returns to the platform.

Popular Fox News host Dan Bongino got some big news after it was revealed his show reigned supreme in the ratings. A new report from Ad Week found that Bongino’s show on Saturday night was the most-watched primetime show in all of cable news.
In the 9 p.m. ET time slot, Bongino racked up 1.19 million total viewers. In the same time slot, CNN had 219,000 and MSNBC secured 315,000 total viewers. In the 8 p.m. ET time slot, Fox News host Brian Kilmeade received 1.06 million total viewers. CNN secured 282,000 total viewers and MSNBC has 282,000 in that same slot.

Moderna and regulatory agencies did not present clinical data on bivalent shots at the U.S. Food and Drug Administration (FDA) and the Centers for Disease Control and Prevention (CDC) committee meetings in June and September 2022, respectively.
Presentations to the FDA and CDC advisory committee excluded data from Moderna’s own clinical study that showed bivalent boosters may be no better at preventing infections than previous booster shots.
The data showed that among people who were never infected, 3.2 percent who took the bivalent booster got infected afterward, while 1.9 percent who took the monovalent booster were later infected.
Advisors to the FDA and CDC expressed concerns of lack of transparency.
Dr. William Schaffner from Vanderbilt University, a nonvoting member of the CDC advisory committee, said that he was disappointed that the data were not presented.
“I think in the interests of transparency, those data should have been presented,” Schaffner said, “though they were very limited, and early data.”
FDA advisor and a professor of clinical pediatrics at the University of California San Diego, Dr. Mark Sawyer, said that he understands people’s concern with the data being excluded, but not all information can be presented.
The committee has limited time, so the information presented must be relevant to the big picture.
More than 1,600 children aged 5 to 11 experienced a systemic reaction such as fever or diarrhea after receiving one of the new COVID-19 vaccines, according to a study from the Centers for Disease Control and Prevention (CDC).
Systemic reactions, defined as “usually mild” and lasting for multiple days, include fatigue, chills, nausea, abdominal pain, vomiting, joint pain and diarrhea. On a severity scale, the category of reactions is between local reactions and severe reactions.
An attorney for Chauvin contended on Wednesday that numerous legal and procedural errors prevented him from having a fair trial.

Hennepin County Judge Peter Cahill had sentenced Chauvin to 22 1/2 years after jurors found him guilty of second-degree murder, third-degree murder and second-degree manslaughter in the May 25, 2020, death of Floyd, whom he pinned to the ground with his knee on Floyd’s neck.
Chauvin later pleaded guilty to a separate federal civil rights charge and was sentenced to 21 years in federal prison. He is now serving that sentence in Arizona concurrent with his state sentence.
Chauvin’s attorney for the appeal, William Mohrman, argued in his brief to the Minnesota Court of Appeals that the pretrial publicity was more extensive than that of any other trial in Minnesota history, and that the judge should have moved the trial elsewhere and sequestered the jury for the duration.

The embattled New York Congressman is facing allegations he conned a homeless veteran out of thousands of dollars intended to save the man’s dying service dog.
The veteran, Richard Osthoff, told the local news site Patch that he met Santos, who introduced himself under the alias Anthony Devolder in May 2016.
Osthoff was honorably discharged from the Navy in 2002 and was living in a tent on the side of Route 9 in Howell, New Jersey, with his service dog Sapphire when he reportedly met Santos.
New York City officials have agreed to remove 441,083 ineligible voters from its voter rolls after a legal watchdog found the liberal-led government refused to clean up its list of voters as required by federal law.
Judicial Watch, a non-profit public interest law firm, filed the lawsuit after an investigation found that in six years, out of 5.5 million voters, only 22 names had been removed for moving away, dying or otherwise becoming ineligible to vote.
“This historic settlement is a major victory for New York voters who will benefit from cleaner voter rolls and more honest elections. Judicial Watch is pleased that New York City officials quickly moved to remove 441,000 outdated registrations from the rolls. We look forward to working together under this federal lawsuit settlement to ensure New York City maintains cleaner rolls for future elections,” stated Judicial Watch President Tom Fitton.
In its announcement of the settlement, Judicial Watch did not state how many, if any, of the 441,083 ineligible names had cast votes. Judicial Watch brought the suit under the National Voter Registration Act (NVRA).

1.1 Provide a one-time, lump sum payment of $5 million to each eligible person. Rationale: A lump sum payment would compensate the affected population for the decades of harms that they have experienced, and will redress the economic and opportunity losses that Black San Franciscans have endured, collectively, as the result of both intentional decisions and unintended harms perpetuated by City policy.
You might worry that blacks given $5 million could blow the money like in the 2003 Dave Chapelle sketch and soon be as bankrupt as an ex–NFL player. But they have a plan to deal with that contingency in their second bullet point:
1.2 Supplement African-American income of lower income households to reflect the Area Median Income (AMI) annually for at least 250 years ($97,000 in 2022). Rationale: Racial disparities across all metrics have led to a significant racial wealth gap in the City of San Francisco. By elevating income to match AMI, Black people can better afford housing and achieve a better quality of life.

Dr. Quintin Bostic, Content Manager at The Teaching Lab, told an undercover Project Veritas journalist that he sells CRT curriculum to schools because the Georgia state government has no idea what he is peddling.
On Wednesday Project Veritas released undercover video of Dr. Bostic admitting the Teaching Lab is ‘like a scam lab.’

The Providence, Rhode Island, Public School District has a loan forgiveness program for new and recently hired teachers, funded by the Rhode Island Foundation, the largest charity in the state. There’s a catch, however. Whites need not apply, it’s only open to non-whites.
Legal Insurrection Foundation has filed a challenge to this overtly racist and discriminatory program, after a 6-month investigation that included obtaining information from public sources and also from records obtained by LIF pursuant to the Rhode Island Access to Public Records Act.
Rep. Sheila Jackson Lee (D-TX) introduced a House Bill criminalizing “conspiracy to commit white supremacy,” which includes criticism of non-white people which influences an individual to commit a hate crime.
The legislation, H.R.61 “Leading Against White Supremacy Act of 2023,” introduced last Monday by Democratic congresswoman Sheila Jackson Lee of Texas, seeks to “prevent and prosecute white supremacy inspired hate crime and conspiracy to commit white supremacy inspired hate crime.”
The congressional bill, which was referred to the Committee on the Judiciary, states that someone engages in a white supremacy inspired hate crime “when white supremacy ideology has motivated the planning, development, preparation, or perpetration of actions that constituted a crime or were undertaken in furtherance of activity that, if effectuated, would have constituted a crime.”

A Washington Free Beacon review of the laptop found four 2017 photographs of Hunter Biden, clad in a white collared shirt and a camouflage baseball cap, behind the wheel of his father's 1967 Corvette Stingray. GPS metadata embedded in the photos indicate they were taken within a minute of each other at 6:49 p.m. on July 30 of that year, just outside the president's Wilmington, Del., residence. The photos show Hunter Biden posing in the vehicle beside two young girls. One appears to be his then-12-year-old niece, Natalie Biden. The other could not be identified.
