President Trump to Sign Executive Order Eliminating Birthright Citizenship

President Trump indicated in an interview with Jonathan Swan of Axios that he plans to sign an executive order eliminating the concept of “birthright citizenship.”

Now, before we dig into the issue, consider the following: the President of the United States has announced that he is ready to unilaterally dismantle a key part of the 14th Amendment to the Constitution. In other words, he’ll be overturning a precedent that has existed for over a century and a half.

That doesn’t mean he’s wrong, however.

Webmaster's Commentary: 

Trump is not wrong in principle. Many nations have recently ended allowing babies born to non-citizens automatic citizenship. But Trump is incorrect in application. He cannot alter the 14th Amendment with an Executive Order. Only another Amendment can do that.

The 14th Amendment was passed in the wake of the civil war, and the citizenship clause was intended to cement the status of the newly-freed slaves as full-fledged citizens of the US with all rights; which the southern Democrats opposed. Back then, immigration wasn't a problem for the US as there was still plenty of room in the west. But today, the problem with the anchor babies has gone out of control, and I agree something must be done.

Trump will never get a change to the 14th Amendment past the Democrats in the Congress and the state legislatures. So we must go back to securing the borders and not letting illegals inside the country in the first place.

We do not need to change the 14th Amendment. We just need to enforce Title 8.
